The National Prosecuting Authority (NPA) has welcomed the life sentence handed down by the Carolina Magistrates’ Court to a 23-year-old man for the rape of his 16-year-old niece.
According to the spokesperson for the NPA in Mpumalanga Monica Nyuswa,, the accused whose name is being withheld to protect the victim from secondary victimisation was sentenced following an incident that occurred on February 05 2023 in Silobela, Carolina.
Although related, the victim and the accused resided in separate homes.
Details of the Incident
“On the day of the incident, the accused visited the victim’s residence and found her alone washing dishes. He took her to a bedroom, raped her, and threatened her not to tell anyone before fleeing the scene,” Nyuswa stated.
The trauma surfaced a few days later when teachers at the victim’s school noticed significant behavioral changes and a sharp decline in her academic performance.
“When questioned, the victim wrote a letter to her class teacher expressing suicidal thoughts. Social workers were immediately called in, and during counseling, the victim disclosed that she had been raped by her uncle and threatened into silence,” said Nyuswa.
The victim’s mother was subsequently informed, and the matter was reported to the police, leading to the arrest of the accused.
The Trial and Evidence
During the trial, the accused denied the charges, claiming he was with a friend at the time of the offense. However, State Prosecutor Makhosonke Mashinini presented compelling evidence, including testimony from the victim, the social worker, and the victim’s mother.
In his address to the court, Prosecutor Mashinini emphasized:
- The high prevalence of rape cases within the jurisdiction.
- The extreme vulnerability of children.
- The serious breach of trust committed by a family member.
- The accused’s total lack of remorse.
A pre-sentence report confirmed the lasting psychological impact on the survivor, noting that she continues to suffer from depression, irritability, and discomfort in the presence of males.
The Judgment
In delivering the sentence, the court found no substantial or compelling circumstances to justify a lesser sentence. Consequently, the accused was sentenced to life imprisonment.
The court further ordered that:
- His name be entered into the National Register for Sex Offenders.
- He be declared unsuitable to work with children.
- He be declared unfit to possess a firearm.

The NPA commended the victim for her immense courage and resilience in testifying despite the threats made against her, noting that her bravery was instrumental in securing the conviction. The authority also extended its appreciation to the social workers and educators whose vigilance ensured the matter was promptly reported.
